Our client was charged in relation to an accusation made by his wife’s friend that he had indecently assaulted her and sexually violated her after a night of drinking in their family home. The complainant had a chronic alcohol problem and a background of making false complaints whilst intoxicated. Our client avoided trial, was acquitted and was granted permanent name suppression due to his unblemished history and the future impact a conviction would have had on his retirement and his wife. If he had proceeded to a jury trial, there was a risk of both conviction and imprisonment. This was avoided with the negotiation we achieved with the Crown and the applications we filed in Court. Both applications were successful – our client was granted a discharge without conviction and permanent name suppression. This is treated as an acquittal and no publication of his name would ever be allowed in the future. This was a a fantastic result for our client who could move on with his life without any blemish attached to his name.
